User Agreement (Public Offer)

1. General provisions
1.1. This User Agreement (the “Agreement”) governs the use of the online service ESimGo: the Telegram bot, the Telegram Mini App and the website (the “Service”), and the purchase of mobile internet plans in eSIM format through the Service. The Agreement is a public offer of the Service’s administration (the “Seller”).
1.2. By using the Service, including starting the bot, opening the Mini App or placing an order, the User confirms that they have read the Agreement and accept its terms in full.
1.3. The contract of sale of a plan is concluded at the moment the order is paid: payment means full and unconditional acceptance of this offer.
1.4. If the User does not agree with the Agreement, they must stop using the Service.
1.5. Integral parts of the Agreement: Refunds and Privacy Policy.
2. Nature of the service and the digital product
2.1. The subject is a digital product: a mobile internet plan in eSIM format for travel abroad. The User receives an eSIM profile (QR code and installation data) and installation instructions.
2.2. The country, data allowance, validity period, price, network type and restrictions of a plan are shown on the plan card and on the Plans and prices page. Plans are data only: voice calls and SMS are not included unless the plan description explicitly says otherwise.
2.3. Before purchasing, the User should note that:
- the device must support eSIM and be unlocked (not tied to a carrier). Compatibility can be checked in the “Compatibility” section of the Mini App before payment;
- the eSIM works on the networks of local operators in the plan’s country; coverage and speed depend on those operators and are not guaranteed;
- the QR code and activation code are, as a rule, single-use: an eSIM profile can usually be installed only once. They must not be shared with anyone — they allow installing the eSIM on another device;
- the User installs the eSIM themselves following the Service’s instructions;
- when the validity period starts is shown on the plan card (“Activation”): as a rule, it starts with the first connection to a network in the destination country. A plan is valid until the period ends or the data runs out, whichever comes first; unused data does not carry over.
2.4. Purchase and delivery:
- The User chooses a country and a plan and taps “Pay”. The Service creates an order; the order price and currency are fixed when the order is created and do not change afterwards.
- The User pays on the payment provider’s page. An unpaid order is valid for 30 minutes and is then closed automatically.
- An order is considered paid only after the payment provider confirms the payment. A success message on the screen without such confirmation does not count as payment.
- After the payment is confirmed, the eSIM is issued automatically and appears in “My eSIMs” in the Mini App together with the QR code and instructions for iPhone and Android.
- If the eSIM cannot be issued right away, the Service retries automatically; no new payment is needed. If the eSIM is never issued, the money is refunded under the Refunds page.
3. Disclaimer of warranties and liability
3.1. The Service and connectivity are provided “as is”. The Seller does not guarantee particular coverage, speed or uninterrupted operation of local operators’ networks, nor uninterrupted and error-free operation of the Service.
3.2. The Seller is not liable for:
- inability to install the eSIM on a device that does not support eSIM or is carrier-locked;
- the User deleting an installed eSIM profile or sharing the QR code or activation code with others;
- connection quality, restrictions and outages in local operators’ networks beyond the Seller’s control;
- actions of third parties, including Telegram and payment providers, beyond the Seller’s control.
3.3. If a paid eSIM is not issued or does not work through the fault of the Seller or its supplier, the Refunds page applies. Limitations of liability do not apply where the law does not allow them.
4. Lawful use
4.1. The Service is not intended to encourage, organise or facilitate unlawful activity.
4.2. The User uses the Service and the eSIM only in accordance with applicable law, the rules of network operators and Telegram’s rules.
4.3. The User is responsible for the lawful use of the eSIM.
5. Intellectual property
5.1. The name, design, texts and software of the Service are protected by intellectual property law.
5.2. The User may not copy, distribute or use the Service’s materials without the right holder’s permission, nor resell or transfer purchased eSIMs for commercial purposes without the Seller’s consent.
6. Restriction of access
6.1. The Seller may suspend or restrict the User’s access to the Service in case of:
- breach of the Agreement;
- detected abuse or signs of fraud;
- requirements of law or of payment providers.
6.2. Restriction of access does not release the parties from obligations that arose earlier.
6.3. The Seller may refuse service to a User whose actions create increased risks for the Service, payment providers or third parties.
7. Payments and refunds
7.1. Payment is made through a payment provider by an available method, at the price shown in the order before payment. Bank card and other payment details are entered on the payment provider’s side; the Seller neither receives nor stores them.
7.2. The terms and procedure for refunds are set out only on the Refunds page, which is part of the Agreement.
7.3. The User agrees not to initiate a payment reversal through a bank or payment system (chargeback) without first contacting the Service’s support.
8. Privacy
8.1. What data the Service processes, why and to whom it is passed is described in the Privacy Policy.
8.2. The Seller takes reasonable measures to protect data, but no transmission over the internet can be completely secure.
9. Changes to the terms
9.1. The Seller may change the Agreement.
9.2. The current revision and its date are published on this page.
9.3. A new revision applies to orders created after its publication. Orders already paid are governed by the revision in force at the time of payment. Continuing to use the Service after publication means acceptance of the new revision.
